General terms and conditions of

Camping Blumengrund GmbH

1. Subject of the contract

Camping Blumengrund GmbH is the operator of the campsite and rents out pitches and accommodation to guests.
The scope of services can be found in the respective booking confirmation.
Additional agreements require separate confirmation.

2. Reservation & conclusion of contract

Reservations can only be made in writing using the contact form on the website.
By registering, the guest offers Camping Blumengrund GmbH a binding contract including these terms and conditions.
The contract is only concluded after the written booking confirmation from Camping Blumengrund GmbH and the transfer of the stated deposit.
There is no entitlement to a specific parking space/a specific accommodation.

3. Fees & payment conditions

The prices to be paid by the guest can be found in the annual price lists of Camping Blumengrund GmbH.
The guest must find out about the prices for the services offered during the registration period.
The guest must pay a deposit of 20% of the travel price to Camping Blumengrund GmbH within the payment deadline stated on the booking confirmation of 14 days after receipt of the booking confirmation.
The remaining payment is made by the guest on site at reception.
If the payment deadline expires, the reservation will be deleted without separate notification and no effective contract will be concluded.

4. Cancellation & rebooking

The guest can withdraw at any time by notifying Camping Blumengrund GmbH.
The decisive factor is the receipt of the declaration of withdrawal by Camping Blumengrund GmbH.
If the guest withdraws from the contract or does not start the trip, Camping Blumengrund GmbH retains, in accordance with the legal regulations, the right to the agreed remuneration less the saved expenses and less any advantages that it may have from renting it out elsewhere arise.
However, Camping Blumengrund GmbH partially waives the remuneration to which it is entitled by only charging the guest the following fees in the event of cancellation or non-attendance of the trip:

20% of the travel price if the guest cancels up to the 21st day before arrival,
40% of the travel price if the guest cancels up to the 14th day before arrival,
80% percent of the travel price if the guest withdraws from the 13th day of arrival.

In all cases, the guest is at liberty to prove that Camping Blumengrund GmbH suffered no damage or significantly less damage as a result of the guest's withdrawal than the flat rate requested by the guest.
In this case, the guest is obliged to pay the lower costs (or, if no damage was caused, not to pay).

The guest has no right to make changes to the travel date or accommodation after the contract has been concluded.
If a rebooking to a new date or a new accommodation is possible and is still carried out at the customer's request, Camping Blumengrund GmbH reserves the right to charge a rebooking fee of 20% of the original travel price.

5. Minimum length of stay & arrival and departure

The parking space is available to the guest from 10 a.m. on the day of arrival.
On the day of departure, the guest must leave the pitch clean and tidy by 1 p.m.
A later departure is only possible after consulting reception for a fee.
However, eviction in accordance with the contract is the guest's main obligation.
If the deadline is exceeded, an additional fee may be charged.

The minimum stay for rental accommodation is 2 nights.
The rental accommodation is available to the guest from 3 p.m. on the day of arrival.
On the day of departure, the rental accommodation must be vacated by 11 a.m.
A later departure is only possible after consulting reception for a fee.
If the deadline is exceeded, an additional fee may be charged.

6. Stay & Visit

The campsite may only be used by the registered number of people.
Visitors must be registered before entering the square.
The guest accepts the site regulations for himself and for the people he has registered.
This is part of the contract.

7. Defects

If the allocated parking space/accommodation or other contractual services do not correspond to the contractually agreed characteristics, the guest must report the defects to the camping management on the day they are discovered, but at the latest on the following day.
If the guest culpably fails to report defects, the guest's claims may be invalidated in whole or in part.

8. Liability

The guest and the people accompanying him undertake to treat the pitch, as well as the buildings, facilities, inventory, etc. of the campsite with care.
Damage caused during the stay by the guest himself or his companions must be reported to the campsite management immediately and compensated, with the exception of proof of non-fault.
The guest’s claims for damages are excluded.
Excluded from this are damages resulting from injury to life, body or health if the campsite is responsible for the breach of duty, other damages that are based on an intentional or grossly negligent breach of duty by the campsite and damages that are due to an intentional or negligent breach of typical contractual obligations of the campsite.
A breach of duty by the campsite is equivalent to that of a legal representative or vicarious agent.
However, the campsite expressly points out that irregularities, damage or losses caused by nature (e.g. branches, weather, animals, etc.) can occur.

9. Severability clause

Should a provision of these terms and conditions be or become invalid, this will not affect the effectiveness of the remaining provisions.
The ineffective provision must be replaced by the statutory regulation.
